THREE U.S. states have introduced legislation designating COVID-19 mRNA injections as
Biological weapons

  1. Tennessee Bill SB1949
  2. Arizona Bill HB 2974
  3. Minnesota Bill HF 3219

Tennessee SB1949, Arizona HB2974, and Minnesota HF3219 are real bills introduced in 2025-2026 that designate specific modified mRNA products, especially COVID-19 injections, as weapons of mass destruction and prohibit their manufacture, possession, or distribution as felonies.

  1. Bills that explicitly designate mRNA products as bioweapons / WMD
None of these have become law.

JurisdictionMeasureYearWhat it would doStatus
MinnesotaHF 3219 / SF 3456, “mRNA Bioweapons Prohibition Act”2025Designate mRNA injections and products as WMD; ban manufacture, possession, distribution; compel officials to enforce; private right of actionIntroduced; remained in committee / recorded as dead without passageLegiscan
ArizonaHB 2974, “Sansone mRNA Bioweapons Prohibition Act”2026Classify modified mRNA as a biological agent and WMD; Class 2 felony; possible terrorism chargeIntroduced Feb 2026; early House action only; did not passBilltrack50
TennesseeSB 1949, “mRNA Bioweapons Prohibition Act” (Sen. Janice Bowling)2026Same WMD designation; Class B felony (tied to existing TN WMD statute); official non-enforcement also an offenseFiled Jan 2026; referred to Senate Judiciary; no enactment as of late 2026Wapp.capitol.tn
CaliforniaDraft “Sansone mRNA Bioweapons Prohibition Act”2026Same model text circulated as a proposed Assembly billDraft circulated; not an enacted statuteJosephsansone

Sansone published 50-state draft versions. Only a handful were formally filed.

Federal Congress: No bill in the 118th or 119th Congress designates licensed mRNA COVID vaccines as bioweapons. Tom Cotton’s S. 1972 “Bioweapon Prevention Act of 2025” restricts federal funding for agricultural labs involving nationals of listed adversary countries. It is not an mRNA-vaccine ban. Existing federal biological-weapons law (18 U.S.C. § 175) already excludes “prophylactic, protective, or other peaceful purposes.”

  1. State bills that ban or restrict mRNA shots as “unsafe” (not WMD language)
Again, none of the outright platform bans listed below became law.
  • Montana HB 371 (2025): Ban administration of “gene-based” vaccines (mRNA, modRNA, saRNA, DNA) in humans; $500 fine per shot. Failed House second reading 34–66; died. Companion HB 418 would have banned the same products in animals; also died.
  • Idaho: 2025 bill for a 10-year moratorium on “human gene therapy products” including mRNA COVID shots (Sen. Brandon Shippy). 2026 follow-on SB 1346 proposed a two-year moratorium for children and pregnant women. Neither became a statewide mRNA ban. Idaho did enact the 2025 Medical Freedom Act banning most vaccine mandates, which is a different legal object.
  • Iowa SF 360 (2025): Ban gene-based vaccines with misdemeanor fines; passed a subcommittee, then was rewritten toward manufacturer-liability waiver rather than an outright ban. No enacted mRNA prohibition.
  • Texas 89th Legislature (2025): Several died in committee, including SB 1887 (ban immunization with mRNA material through 2035, cancer/genetic-disorder exception), HB 5022 (same concept), HB 3737 (ban prescribing/advertising COVID mRNA shots), and HB 3176 (ban manufacture/sale of mRNA communicable-disease products).
  • Kentucky SB 177 (2025): Ban COVID/mRNA/modRNA requirements for school, work, or treatment; ban administration to minors until July 1, 2035. Died in Senate Health Services.
  • Oklahoma SB 1938 (2026): “DNA/RNA-Based Vaccine Safety and Sovereignty Act” — ban use, sale, and distribution of DNA/RNA-based vaccines in humans, animals, and produce; civil fines from $50,000 and felony exposure. Introduced; referred to Health; not enacted as of this writing.
  • Louisiana SB 36 (2026): Prohibit food as an mRNA-vaccine delivery system and tighten vaccine consent rules. Narrower than a shot ban; still pending/unenacted as a full platform prohibition.
  • Mississippi HB 811 (2026): Prohibit mRNA in food products and livestock intended for human consumption. Died in committee.

  1. Local and party actions (no force of law)
These are political resolutions, not ordinances.

Florida county Republican executive committees that passed “Ban the Jab” language calling COVID/mRNA shots “biological and technological weapons” and asking the governor to ban and seize inventory include Lee, Collier, Lake, St. Johns, Santa Rosa, Seminole, Hillsborough, and Brevard. Similar resolutions were adopted by the Maricopa County GOP (Arizona), the Idaho Republican Party, and Clackamas County GOP (Oregon). Governors and attorneys general were not legally bound and did not seize product.

Sansone also filed Florida litigation arguing existing state WMD statutes already cover mRNA shots and seeking a writ of mandamus against the governor and attorney general. That is a lawsuit, not legislation, and it has not produced a statewide ban.

No city or county ordinance independently criminalizes possession or administration of licensed mRNA COVID vaccines as bioweapons.

  1. Federal and Florida policy findings of limited use or unsafety (not criminal WMD laws)
These changed access and official recommendations. They did not reclassify the products as weapons.
  • HHS / CDC (May–Oct 2025): Secretary Robert F. Kennedy Jr. removed the routine COVID-19 recommendation for healthy children and healthy pregnant women. A reconstituted ACIP later moved toward individual decision-making rather than a universal annual recommendation.
  • FDA (2025): Updated COVID shots were approved mainly for adults 65+ and people with high-risk conditions. Remaining COVID emergency-use authorizations were rescinded, which narrowed pharmacy access for healthy younger people.
  • Florida Department of Health / Surgeon General Joseph Ladapo: Multi-year guidance against mRNA COVID shots for healthy people; 2024 recommendation against use citing unproven safety; 2025 public statement that “the goal with the mRNA is for that not to be available to anyone.” That is executive/public-health guidance, not a statute banning the products. Florida later moved to drop some school vaccine mandates by rule; the legislature did not pass a full mRNA criminal ban.

5. Foreign countries, councils, and societies

No sovereign government has enacted a statute declaring licensed mRNA COVID vaccines to be biological weapons.

  • Japan: Did not ban mRNA COVID vaccines. The emergency free-vaccination program expired in 2024; shots remained available, with subsidy focused on older adults.
  • Slovakia (2025): Cabinet paused further COVID vaccine purchases pending a Slovak Academy of Sciences safety review after PM Robert Fico and envoy Peter Kotlár raised DNA-contamination claims. That is a procurement freeze, not a bioweapons statute.
  • EU / UK / Canada / much of high-income Europe: Shifted to risk-based, older-adult-first COVID boosters. Those are schedule changes, not platform criminalization. Earlier 2021 pauses of AstraZeneca (adenoviral vector, not mRNA) over clotting.
  • World Council for Health (2024): Advocacy group letter calling for “immediate suspension” of mRNA vaccines, signed by a small number of lower-profile politicians from Finland, Lithuania, Greenland, Sweden, Czechia, and Australia. It is not a government council and bound no country.
  • Medical societies: Mainstream bodies (AMA, AAP, IDSA, WHO, EMA, and the industry group Alliance for mRNA Medicines) have opposed WMD-style bills and continue to treat licensed mRNA COVID vaccines as medical products, not weapons. No national medical academy was found that has issued a formal designation of the licensed shots as bioweapons.

The current inventory is:

  1. Zero enacted U.S. or foreign statutes designating licensed mRNA COVID injections as biological weapons.
  2. Three formally introduced state WMD/bioweapons bills with public records (Minnesota 2025, Arizona 2026, Tennessee 2026), plus circulating 50-state drafts.
  3. A larger set of failed or pending state bills that would ban or moratorium mRNA immunization without using WMD language (Montana, Idaho, Iowa, Texas, Kentucky, Oklahoma, and narrower food/livestock bills).
  4. Nonbinding county/state party resolutions, concentrated in Florida GOP chapters.
  5. Real 2025 U.S. federal and Florida policy tightening that treats the shots as having an unfavorable risk-benefit profile for healthy young people, which is a recommendation/labeling change, not a weapons designation.
